...the victim was making a sandwich in the kitchen of the home when 45-year-old Todd Tracy Hicks (shown) tapped him on the shoulder and told him to get on the ground...
Instead, the victim started punching Hicks repeatedly in the face and then held him until police arrived.

So the proper course of action is to do, ...what?

A drunken, unarmed stranger suddenly appears in one's house and states you must comply with his commands and the best course of action is to passively follow his instructions?

Do I have that right?

If so, I think that might be the best course of action if the criminal has immediate control of a weapon and one is caught completely off guard without immediate recourse to a weapon of his own, but otherwise...it would appear the LEO is asking people in general to be unresisting victims.

The comments add something missing from the story. Apparently the burglar is a habitual criminal known in the neighborhood who has broken into many homes (lives in the area with his wife), spends some time in jail, and then gets released back into the neighborhood to do it again.

...and there in lies some of the problem. Excuse me but "habitual criminal?" Has he not been sentenced for his prior crimes? How many more crimes would be necessary for an extended sentence to be administered?

Well, this just comes from comments by people claiming to be neighbors. I don't know what the law is for habitual criminals in Oklahoma. I suspect that if he has been arrested many times as claimed, he wasn't prosecuted due to circumstances like lack of evidence. The article says he was drinking so most of his arrests may have been for public intoxication and hence, not crimes that lead to sentencing for habitual criminality. But the gist of the comments is that the guy is a known problem in the neighborhood.
