Follow Up to NICS Denial

Earlier this summer I was denied by NICS and posted a thread about it viewtopic.php?f=7&t=45942. I wanted to follow up and give you guys the one major piece of insight that I've gained from this whole experience. Which is, if your name has a suffix and you fail to include it and it results in a denial, DO NOT try to amend the denied transaction. Just have the FFL do a new transaction with the corrected name. The reason given for my denial was that me or someone with a similar name committed a crime which resulted in over a year being spent locked up. I share a name with my father and grandfather who both fall into this category, while I've never been arrested. The NICS system is entirely name and description based, so my differing birthday did not matter. Nor did providing my SSN.

The most efficient way of getting through this situation was simply applying for my CHL. The appeal process with the FBI is only good for that transaction, unless you apply for a VAF number to use with all NICS checks afterwards. It's average wait time is also currently quoted at around 120 days, which is a long time to wait. As I was told in my previous thread, a denial does not get in the way of you getting your CHL, since the prints you submit to the state through FAST are also sent to the FBI. Why they are willing to take electronic prints from the state, but not citizens, is a mystery, but it means that you're effectively doing the FBI appeal without having to wait as long when you apply for your CHL.

In the end, I guess the real lesson is if you're a JR,III, etc. ALWAYS PUT IT DOWN ON FORMS. Your parents criminal record could come back to bite you in the ass.

Glad it all worked out. I went thru the same process due to a person with my same first, last, middle initial, and birth date who of course is a convicted felon. Providing place of birth and SS# made no difference.
I was only denied one time and that was while my CHL was processing. Was told by another NICS agent that it was obvious by my description that I was not the same person but some agents are anti 2a and look for an excuse to issue a denial. Now that I have the CHL NICS shouldn't be a problem but haven't needed to run one because of the CHL.

That would seem to render the system pretty much useless, but then it was all about 'appearing' do to something;
in politics appearing to do something is more important that actually doing something.
