Re: Florida makes gun restrictions illegal
Not enforced how? If Tampa illegally made something illegal, and I was arrested for breaking it, wouldn't "the law itself is illegal" be a valid defense?bnc wrote:The law making local gun laws illegal has been around since the 80's, but wasn't previously enforced.
I am not a lawyer, nor have I played one on TV, nor did I stay at a Holiday Inn Express last night, nor should anything I say be taken as legal advice. If it is important that any information be accurate, do not use me as the only source.
Re: Florida makes gun restrictions illegal
Not enforced in the sense that there was no penalty for counties and municipalities who violated preemption. The new law puts some teeth in it.

Re: Florida makes gun restrictions illegal
Seems kinda like Texas' Preemption law, but makes cities clean up their ordinances, or get fined, instead of the letter writing/ e-mails we have to send to educate the cities to remove signs and update parks ordinances etc
I'm no lawyer
