CHL application with an alcohol arrest
I am to do a private class for a Marine tomorrow. He has called saying he was doing the app online and he is concerned now as 4 years ago he was arrested for a DUI. He says they did not even take him to jail, but given community service only. he doesn't remember what class of misdemeanor this was. Should he bother or not?

If he doesn't know the actual charges and the disposition, the rest of us would just be guessing. BUT. If it was a class A or B misdemeanor and he was convicted (which doesn't necessarily mean jail time) then he has to wait five years before he's eligible.
Sad commentary that after waiting 5 years, he might get his CHL free, but some RN who doesn't drive drunk has to pay $140.

...something's not accurate...if you're arrested, you're booked into jail...the booking record will reflect the actual charge(public record) and if he didn't go to jail...who gave him the community service order??? You know seriously, seemed like a fine, polite young man. A US Marine, but has to wait. Part of me wants to think "unfair" but really this shows that our actions have consequences farther than we can predict. Sounds like sermon fodder...

This is not accurate information... If he was convicted of DUI, not DWI (6) does not apply. Not only that, the definition of a chemically dependent person says two or more convictions in a 10 year period.bkj wrote:(6) is not a chemically dependent person;

Remember DUI only requires "a detectable amount" of alcohol be present in a minor's system.

Yep. I'm almost sure that's what this is, because a DWI is a Class B, even for a minor. So must have been DUI Class C... If we start weeding people out for Class C's, anyone who's had a speeding ticket is gone. Is being a law abiding citizen REALLY that hard?
I was laying over in El Paso some years ago and got to talking with another pilot, who was a LEO pilot in Montana or Idaho etc., and told me that some enormous percentage of the people who apply to become law enforcement officers are ineligible because of past convictions, DUI, drugs, petty theft, etc.
Doesn't any body have a grandmother anymore? How does this happen so often?

What the guy was convicted wasn't even a crime when many of us were 18... The confusion is that in Texas DUI is a low grade offense...for catching under 21 with any detectible alcohol in their system. It's not driving while intoxicated.
