Warning Lands Mesquite man in Jail - Russ Martin show

So I was hearing on the Russ Martin about a guy that shot a warning shot into the ground and then the police came and arrested him for discharging a firearm in the city, something to that affect. I just read in the Handgun Combat magazine an article from Masaad A. about how giving a warning shot is not a good idea. But in some instances can be useful.

Then a caller said that Texas statue says that we are not to give a warning shot.

Thoughts? Anybody have a link to an article on this?
