While looking for the Beaumont Enterprise article featuring MoJo, I found this story and had to share it.
The lawsuit alleges that the black marble bench became extremely hot and unreasonably dangerous after being exposed to the sun on an August day.

The stadium didn't warn Carillo or others about the potential dangers, the lawsuit claims.

Suing for loss of earning capacity :confused5 Guess she can't sit on her lazy bohunkus anymore. :banghead:

Is this the same person who filed a lawsuit against McDonalds years back for the hot coffee burning her.

A third degree burn is a serious injury.

This is Texas, and most exposed black surfaces get pretty warm in the sun. Either marble gets exceptionally hot under these conditons, or the plaintiff failed to remove herself from contact with a hot surface in a reasonable time (say about .1 seconds) as most folks would.

Since the bench has apparently been there for quite a while and the plaintiff is apparently the only person claiming injury from it, I look forward to hearing about the evidence once it is presented at trial.

:iagree: Unless that person was not physically capable of removing themselves from the bench I find it hard to believe that the person suffered third degree burns. As Excaliber said, we will have to wait and see what evidence is presented.

That said, a black marble bench in Texas doesn't seem like a very good idea.
After sitting in the sun all day, the black steering wheel of my car gets awful hot.

I am not a doctor, but ice is an excellent antidote for touching hot stuff. :tiphat:
