LA's Act 874 - Strict Scrutiny When Limiting RKBA

Post by hpcatx »

As I'm watching election returns, I'm excited that Louisiana's Act 874, a proposed state constitutional amendment that will strengthen existing RKBA language, looks like it will likely pass. Right now, it's up 75% to 25%, with 87% of the precincts reporting. (1,054,322 votes to 351,946, with 3722 of 4267 precincts in.)
Existing Article 1, Section 11 Language wrote:§11. Right to Keep and Bear Arms
The right of each citizen to keep and bear arms shall not be abridged, but this provision shall not prevent the passage of laws to prohibit the carrying of weapons concealed on the person.

Louisiana Constitution of 1974
Act No. 874 Proposed Change wrote: §11. Right to Keep and Bear Arms
The right of each citizen to keep and bear arms is fundamental and shall not be infringed. Any restriction on this right shall be subject to strict scrutiny.

Act No. 874
Now, I only hope that some of the restrictions on conceal carry will be successfully challenged under the new strict scrutiny standard. I sure do miss only looking out for 30.06 signs, an express CHL line at the capitol, etc. I don't open carry, so it's not a right that I exercise here.
