First time seeing this kind of sign

Post by trentwhite778 »

I'm sure this has been discussed, but I couldn't find anything in a search.
My neighborhood convenience store just got bought out and has been changed to a 7-11. Tonight I noticed a new sign that I haven't seen anywhere. There are a couple of standard 'Gun Busters' signs and the generic 'unlicensed possession' signs, but this is the first time I've seen this one anywhere. I went ahead and just carried right passed it as it is neither a 51% sign nor a 30.06 sign, but I'm just curious if this is a common sign as I've never seen it before.
Sorry for the blurry pic.

It's frustrating because the law and the TABC code that it is citing are both dealing with unlicensed carry but the language of the sign makes it seem like it's saying it's illegal period.

§ 61.11. WARNING SIGN REQUIRED. (a) Each holder of a
license who is not otherwise required to display a sign under
Section 411.204, Government Code, shall display in a prominent
place on the license holder's premises a sign giving notice that it
is unlawful for a person to carry a weapon on the premises unless
the weapon is a concealed handgun of the same category the person is
licensed to carry under Subchapter H, Chapter 411, Government Code.
(b) The sign must be at least 6 inches high and 14 inches
wide, must appear in contrasting colors, and shall be displayed in a
conspicuous manner clearly visible to the public. The commission or
administrator may require the holder of the license to also display
the sign in a language other than English if it can be observed or
determined that a substantial portion of the expected customers
speak the other language as their familiar language.

PC §46.035. UNLAWFUL CARRYING OF HANDGUN BY LICENSE
HOLDER. (a) A license holder commits an offense if the license holder
carries a h andgun on or about the license holder's person under the
authority of Subchapter H, Chapter 411, Government Code, and
intentionally fails to conceal the handgun.
walkway, parking lot, parking garage, or other parking area.
(g) An offense under Subsection (a), (b), (c), (d), or (e) is a Class A
misdemeanor, unless the offense is committed under Subsection (b)(1)
or (b)(3), in which event the offense is a felony of the third degree.

I have not seen one like this either. My guess would be that this particular store's owner found this sign on the internet and ordered it, without doing much research, and just stuck it on this window. As you noted, it is effectively the same as the "unlicensed possession" signs.

i remember that sign from years ago. I still see them on occasion but they do not have any bearing on CHL.

Thanks for confirming...I was thinking I had seen it, but not for many many moons.

At any rate, execute "LeRoy Van Dyke Protocol".....just walk on by. :)

My local convenience store had a similar one that I posted last year:

viewtopic.php?f=53&t=34571&start=150#p628538" onclick="window.open(this.href);return false;

I carried past that one too. They've since replaced it with a correct "unlicensed possession" sign.
