two friends/CHL with past criminal records?

Post by 1s1k52 »

This isn't one of those "its for my friends but really for me thing" I have plastic already.

I have a friend with a child on the way. April marks the 5 years of his DWI. Everything was paid for he is legal to drive etc. Could he still be denied? Anything he should know. I am trying to get him to join this forum in the meantime I want to help him get his plastic. I realize the statement of DWI and CHL paint a pretty stupid image of him but judging aside if anyone has some ideas let me know.

Another friend doesn't know if he wants one or not so I am just curious. When he was 19 he entered a small party at a hotel that was busted shortly after his arrival resulting in charges for some sort of drug possession. Basically everyone there got a charge due to the amount. Anyways he served his small sentence of jail/community service court crap etc supposedly none of it is on his record.

I wouldn't be bothering to ask this question if I knew these guys were still the same people but their not at all. What I have suggested so far is requesting copies of their records and reviewing the latest requirements to obtain a CHL on the DPS website. That is all I knew to do at this time.

Multiple drug or alcohol convictions can be considered as evidence of someone being a chemically dependent person and ineligible, but a single class A or B misdemeanor conviction only disqualifies somebody for 5 years.

Friend 1 should be good to after the 5 year mark. Tell them to make sure that April was the date of the conviction, and be prepared to provide certified disposition paperwork along with their application.

Friend 2, it's hard to say for sure. It would depend on what the actual charge/conviction was for, and how long it has been. He would also need to provide a certified disposition along with his application.
