Bounce check

Post by thatguy »

We received a bounced check from a CHL student which has never happened to my knowledge. Do I have any recourse through the State of Texas at stopping his CHL application or is it a civil matter?

strictly a civil matter, take it to your local JP and file issuance of a bad check

Maybe a stupid or naive question but, did you contact said student. Could be honest mistake and they may rectify immediately.
Armed not dangerous but potentially lethal.

Did you try contacting the student? Maybe it was just a mistake.

Yes, we have made several attempts at reaching said student but no luck. Not something I would expect from a CHL applicant..

I would notify DPS. They might not be too excited about issuing a CHL to such a jerk.

It is not quite just a civil matter. You can always file criminal charges for theft of service by check. That makes it a class B misdemeanor (over $20 and under $500) and that should hold up a CHL.

If this is the way you want to go, check with your local DA.

We get a couple checks a month that bounce. A simple call to the writer and explain and they apologize and reissue a good payment either through credit card or a new check.

If the check bounced because of NSF funds, you can always take it directly to their bank to have it drawn against the account (again). Usually if you go on the first or 15th day of the month, or every other Friday, you can almost always get the money at some point. Some banks will even verify availability of funds if you call them and ask for a verification. That takes making 'contact' with the check writer out of the issue if they are not returning/avoiding your calls. If it was returned due to closed account, then you can file charges with the DA for theft by check - make sure you have notified the check writer by certified mail of the situation. You can file theft by check charges if it is NSF funds, too, but usually you have a better chance of recovering money if you work it out before charges are filed. I know, I know, so many hoops to jump through for something that is rightfully yours, but if the check writer isn't cooperating, then I would imagine he has done this to other people as well. Time to make an example of him or her.

I am not a lawyer, but I did run the finance department of a multi-million dollar real estate company, and I collected on MANY NSF checks!! Good luck!

Right on! You are out your fees; however, there is a larger issue on the table here. Go after 'em!

I'd be shocked if the state showed any concern. I withhold their CHL-100 form until the check clears, then I drop it in the mail to them.

That seems a reasonable thing to do for those who want to pay in this manner.

Have you had issues with bad checks, too?

Heck no, somebody would have to give me one of any kind first :evil2:
I am a homeless instructor for now. A new range is going in nearby and a larger one is planned in Fort Worth. I'm hoping to be allowed to use those facilities if possible. I shared a class recently with one of the owners. Nice guy. Should be a nice range as he described it too. I'm just tickled to have closer places coming along to practice.
