OC in OK

Post by txglock21 »

I have searched for an existing thread to no avail and went to ushandgunlaws, but couldn't completely understand the "legalise" there. My question is, can I with my Texas CHL open carry in Oklahoma? One part said only CC for other states in OK, then other parts said, whatever the law is for the state of the CHL issued, while others parts say whatever the laws of OK are. Very confused at this point. All I need is a yes or no. Thanks in advance! :confused5

From the first post in that thread...
2) I have a license issued by another state, can I open carry in Oklahoma?
(Section 1290.26.) "Any person entering this state in possession of a firearm authorized for concealed or unconcealed carry upon the authority and license of another state is authorized to continue to carry a concealed or unconcealed firearm and license in this state; provided the license from the other state remains valid. The firearm must either be carried unconcealed or concealed from detection and view."
OK Statute here: http://www.oscn.net/applications/oscn/D ... teID=69809" onclick="window.open(this.href);return false;
The State of Oklahoma hereby recognizes any valid concealed or unconcealed carry weapons permit or license issued by another state, or if the state is a nonpermitting carry state, this state shall reciprocate under the permitting law of that state.

A. Any person entering this state in possession of a firearm authorized for concealed or unconcealed carry upon the authority and license of another state is authorized to continue to carry a concealed or unconcealed firearm and license in this state; provided the license from the other state remains valid. The firearm must either be carried unconcealed or concealed from detection and view, and upon coming in contact with any peace officer of this state, the person must disclose the fact that he or she is in possession of a concealed or unconcealed firearm pursuant to a valid concealed or unconcealed carry weapons permit or license issued in another state.

Thank you for your response, I had already read that and to me it sounds like it says, if you can only carry concealed in your home state then you only carry concealed in Oklahoma. This is what is confusing to me. Am I reading this wrong?

I read further down on the link you posted to the OK forum and saw where C-dub asked them the same question I was asking. Their response was, "you follow the rules of the state you are in." (Which makes sense.) So I guess its ok to carry either concealed or open in OK with a Texas CHL. Thanks again for your help.

yes we can open carry or no we cannot in OK?
Yes, we can! (Sorry, couldn't resist) Seriously though, if you have a valid CHL recognized by OK, you may OC.

You can also OC where legal in MO. In MO, it's up to localities whether OC is allowed or not, and some place certain restrictions. Springfield is good for OC, regardless of whether you have a CHL or not. Bolivar requires you to have a CHL to OC.

Here's the way I read this... Please note that I am not a lawyer and this is not legal advice... Just my opinion..

"Any person entering this state in possession of a firearm authorized for concealed or unconcealed carry upon the authority and license of another state is authorized to continue to carry a concealed or unconcealed firearm and license in this state; provided the license from the other state remains valid."

My TX-CHL authorizes me for concealed carry in my home state... therefore.... I am authorized to carry concealed or unconcealed in OK.
My TX CHL authorizes me " to carry a concealed or unconcealed firearm and license in" Oklahoma.
If I had a Texas Open Carry permit (if one existed), I would also be allowed to OC or CC in OK, the way I read it...

Legalese is a pain sometimes...
