Austin: Assault with multiple deadly weapons

In a dog park in Austin, in June, a 46-year-old beauty queen allegedly became upset with a dog owner who allegedly did not clean up after his dog. The woman allegedly threw "dog poop" and a rock at the offender, and spit on him.

Then for good measure, she allegedly attacked another dog owner.

She was arrested and charged with aggravated assault with a deadly weapon.

Though the rock was apparently the element that got her a ride and complimentary stainless steel bracelets, biological materials have been determined to be deadly weapons in a massive body of case law.

I have had dogs, cats, and/or horses most of my life. I have to say I have seen a lot of kooky behavior involving animals.

This lady was not the "poop" police , sounds like a nutter to me .

You got that right.

Last year my wife was walking the Corgi in an RV park and the dog happened to squat and pee on the grass island between sites (we always pick up after the dog and follow rules). A grumpy old dude came out of the motorhome and ripped her up one side and down the other for letting the dog pee on "his" grass. Wife was very upset and I walked over to grumpy and apologized for the incident a couple of hours later. He wanted to rehash the entire situation and I said I wasn't interested. Then I said if he ever has a problem with the dog or wife's behavior, he needs to talk to me and not the wife.

You could see him get very tense and he said he would not comply, bla, bla, bla. He pointed his finger at me and I brushed it away, then weirdo said "I better leave.." which I did; this guy has a screw loose or was off his meds. Next day I had the wife document the experience and how she felt threatened and we gave a copy to the park's management a copy of the letter. They were surprised at this guy's behavior as was I since they had a dog.

There's some bizarre people out there.

How about charging them with the crime they committed instead? Simple assault... Every day I shake my head at our legal system more and more.
This lady deserved the ride, but unless it was a BIG rock, the charge is a bit ridiculous.

Ask Goliath how deadly rocks can be. ;-)

There's plenty of case law determining rocks and bodily discharges to be deadly weapons.

Most likely, though, the suspect will plead to assault and get probation. It doesn't make sense to put someone in prison for what is basically a temper tantrum.

The fact is there are lots of nutty people out there.

Some have animals, some don't.

Some fixate on others who have animals, some don't.

The only common element is that they're all nuts.

It was a 6" rock with a jagged edge, according to the articles.

Give me an itty bitty rock and let me throw it at you. I am not a Nolan Ryan but I bet I can raise a knot on your noggin.

This kind of falls in line with those who spout that a .22 LR is a useless self defense round.

Let me shoot you with a 22.

I bet I get no takers on the rock either.
