FL: LEO Shoots Man Rummaging in Car Late Night

Post by jerry_r60 »

This sounds like an ugly situation that could have been much worse. At least the guy wasn't hurt worse or killed.

Seventeen shell casings were found in the carport, family members said.
They shot 17 times. There were bullet holes every which way, car door, back of car, house door, and they only managed to shoot him on the leg. He was lucky they were not very good shots. Based on the accounts, is not like he was running around. He pretty much was standing still by the car door.

Thank god he was not killed. Now we need to get at the bottom of WHY the LEO's fired on him. I am glad oth the LEO and the citizen get to tell their side of the story.

From the guys comments and I could just imagine my own reaction in the middle of the night...."Get your hands where I can see them", not sure it would immediatly register that the police are talking to me. I could imaging being startled by a commanding voice behind me in the middle of the night and turning around to see who/what.

What did he expect when he "lunged out of the vehicle and spun toward them [the police officers}" Cops have to make sure they get home every night. Rummaging through your mother's car at 2:40 a.m., what was he thinking.

Look, the way I see it.. He received 16 warning shots before they decided to use non-lethal force to disable him.

There was a story recently about a man who shot a 14 year old boy in his yard at 2 am, the kid made a funny move, was shot once and died, and the homeowner was charged with 2nd degree murder. Here, the deputies claim the victim, if that is the right word, "lunged and spun at them" at 2 AM, so they fired 17 rounds and go on paid administrative leave.
Luckily, I have enough willpower to control the driving ambition that rages within me.

You know, I worked a lot of swing shift (second shift) when I was in the Air Force and I liked working at night. Guess I'll have to rethink my desire to find a nightshift job...what if I left something in my truck and went back out after it at the wrong time?

I was on call at a previous company, and was often called at 11 pm - 6 am for repair work. I was always a bit nervous when trailed by the cops at 2 am - now I know why.

If cops surprise someone, shouldn't they expect the person to act surprised?

I often times remember something I've left in my truck or am just plain looking for something that might have been left in my truck after dark, but never at 0300. It's going to be interesting how this plays out. I wonder which neighbor it was that called and what they were doing up at 0300.
I am not and have never been a LEO. My avatar is in honor of my friend, Dallas Police Sargent Michael Smith, who was murdered along with four other officers in Dallas on 7.7.2016.

What I would like to know is what a teenage girl was doing up at 3:00 AM.
A teenage girl who said she witnessed a portion of the incident said she never saw Middleton provoke the deputies: "He wasn't belligerent or anything."

It's amazing that Law Abiding Citizen is still alive after enduring a small arms assault. He was accused of a crime, judged guilty by the LEO's and nearly executed. And no crime was ever committed. Until the LEO's got there...
