Nope. Even if her death was not intended, he still intentionally fired the weapon. Has to be charged in her death.

I'm still trying to picture in my mind how someone committing suicide ends up missing, shooting himself in the hand and hitting someone else.

There were two separate shots. The first one killed his girlfriend. The second was after the police arrived and he was trying to escape.
