51% Sign Prominently Displayed . . .

We all know the law about the 51% sign at a bar. Texas law says it will be prominently at the entrance, specific colors, contrast, etc. Let me tell you about my experience at Wurst Fest in New Braunfels last November.

Since Wurst Fest sells a ton of food, I was unsure of their qualification. As I walked up to the main gate I was eyeballing the front of the ticket booth, the lanes to the left to enter, and all around. Nothing to be seen. I think, OK, I understand. They do sell a lot of beer, but I know they sell a lot of food. (As I can testify when I leave.) As I'm walking through the turnstile I just happen to glance up and to the left. And I see it. Mounted about ten feet high, to the left, mounted on a rafter, facing away from frontal view, the 51% sign.

As a dutiful CHL holder and instructor I turned around, went back out, and stowed my conceal. I should have brought it to someone's attention but I promptly forgot about it. When I go back this year I will see if it's still there. If it's not displayed properly I will bring it to their attention. We'll see what happens.

I see many places that violate some part of that line of code.

More commonly "...at the entrance..."

I see the sign hanging above the bar.

Just because a sign is posted does not mean the place is off limits....... check the TABC public search for the actual determination.

On these temporary venues you need to be careful as the database may not get updated as quickly as they get their license. In the case of Wurstfest they do show up and ARE a 51% licesne. Can't say I am suprised as they sell a TON of beer during these Octoberfest type celebrations. :cheers2:
