I have not followed this case and am not even certain I'd heard about it before. There was another case like this in Dallas and one of the officers was killed, but I don't recall the outcome of that person's trial at this time.
I'm not surprised at this result and not very disappointed either. I am very sorry for the officers that were shot. What I hope this does is force LE to rethink no-knock warrants and find a better/safer way to accomplish their goal.

I am not and have never been a LEO. My avatar is in honor of my friend, Dallas Police Sargent Michael Smith, who was murdered along with four other officers in Dallas on 7.7.2016.

I've never experienced a "flash bang" grenade's effects, but from everything I've read you wouldn't be able to hear "police, police" being yelled.

Jurors explain why they acquitted man of officer involved shooting
Jurors referred to the officers’ differing testimonies about what Rosas said and how he acted when police restrained him. Some officers described him as aggressive and directing profanity toward the police. Other officers said he was cooperative and told them he didn’t know they were law enforcement.
Jurors also challenged some of the tactics used or missing during the raid. They asked why there wasn’t video from a body camera or the SWAT vehicle. They questioned why police didn’t survey the house hours before going in and were surprised officers didn’t make sure the person the warrant named was in the house before the raid.
They also said they were bothered one of the charges Rosas was indicted on was for a gunshot that tore through Officer Ross Murray’s pant leg. Officers testified the bullet came from Ruebelmann’s gun. Greenberg asked why, then, Ruebelmann wasn’t facing the same charge as Rosas.

The judge in the case made it a point to tell the jury that the prosecution failed to produce 22 items of evidence that it was required by law to turn over to the defense. He said it was the first time in 27 years on bench that he had to do that.
The current DA will be replaced in January, and the judge publicly welcomed the change. For him to say that out loud I think shows how disgusted he was with prosecution. He said he had considered throwing out the case altogether.

This was a trial court, but the prosecution's case was such a hot mess I doubt the new prosecutor goes for any kind of appeal. Not sure, but I am thinking that the only thing the prosecutor could appeal on is the judge's handling of the case, i.e. argue that his listing the 22 items mishandled by the DA was not legal, and I'll bet that's a pretty weak to non-existent reed.Russell wrote:I don't know that we do unless this was an appeals court decision.Jago668 wrote:I'm glad he didn't. The article also noted that entire prosecution team was changed just a few weeks before trial -- didn't say why, but I would guess the evidence mishandling might have had something to do with it. In any case, I'll bet the new DA makes some personnel changes.
